Speaking at Andover Mutual Business Group’s May breakfast meeting will be Dennis McNamara who is a Family Law specialist with DBB Solicitors who have offices in London Street, Andover and Clarendon Terrace, Stockbridge.
Dennis will talk about Family Law in general including divorce in the internet era but will then concentrate on financial issues. He says it’s surprising how many people do not properly sort out their finances at the time of divorce particularly if they have not taken legal advice and end up, sometimes many years later, and notwithstanding that they are in new and settled circumstances, having to then face and deal with an Application for Financial Orders brought by an ex spouse.
Another area of great contention is about spousal maintenance and that in England and Wales we still have what are known as “joint lives orders”. Dennis says that this is one of the biggest causes of complaint about Matrimonial Law in this Country. Many clients believe this to be unfair and unjust. When would it be reasonable for a wife to return to work whilst looking after children? There is certainly Case Law about it!
What about pensions? Who gets what? This is traditionally an area where the interruption to a carer’s career means that he/she suffers. How is that being tackled? Dennis says this is an issue that is being treated much more seriously and more fairly nowadays.
